1. About this Policy

Jarvis understands the importance of protecting personal and financial information provided by customers in connection with finance applications.

This Finance and Credit Information Policy explains how Jarvis collects, holds, uses and discloses personal information and credit-related information when assisting customers to obtain vehicle finance through our panel of lending partners.

For the purposes of this Policy, Jarvis means the Jarvis Group entities listed in section 17 of this Policy, both collectively and individually.

This Policy should be read together with the Jarvis Privacy Policy and Privacy Collection Statement.

2. Jarvis’s role in arranging finance

Jarvis is not the credit provider.

Our Business Managers assist customers to explore and apply for finance by collecting relevant information, assisting customers to identify potentially suitable finance options and submitting finance applications to one or more lenders on our panel.

Any loan ultimately entered into is between the customer and the relevant lender, subject to that lender’s lending criteria, assessment, approval, fees, charges and terms and conditions.

The lender, rather than Jarvis, is responsible for making the decision about whether credit will be provided and for administering the credit contract after settlement.

The lender to which your application is submitted will be identified to you as part of the finance application process.

3. Information we may collect

When assisting you with your finance requirements or a finance application, Jarvis may collect personal and financial information reasonably required to understand your requirements, identify potentially suitable finance options, conduct an authorised soft credit check, prepare an application and submit the application to a lender.

This may include:

  • your name, date of birth, residential address and contact details;
  • driver’s licence, passport or other identification information;
  • employment and income information;
  • details of your assets, liabilities and regular living expenses;
  • information about existing loans, credit facilities and financial commitments;
  • details of the vehicle or other goods being financed;
  • information about your proposed deposit, trade-in or other contribution;
  • bank statements, payslips, taxation information or other documents supporting your financial position;
  • information concerning your residency or eligibility to enter into a credit contract;
  • information relevant to a guarantor or co-borrower, where applicable;
  • credit-related information obtained from Equifax where Jarvis conducts an authorised soft credit check;
  • information obtained or generated as part of the relevant lender’s finance application and assessment process; and
  • other information reasonably required by Jarvis or a lender to facilitate your finance application.

Where you provide us with personal information about another person, such as a joint applicant or guarantor, you should ensure that you are authorised to provide that information.

4. How we collect information

We generally collect information directly from you during the finance process, including through discussions with our Business Managers, electronic or paper application forms and documents supplied by you.

With your authority and where permitted by law, information may also be collected from or exchanged with:

  • a lender on our finance panel;
  • Equifax, including where Jarvis obtains a soft credit check with your consent as part of assisting you with your finance requirements;
  • a credit reporting body used by the relevant lender as part of that lender’s credit assessment process;
  • your accountant, employer or another person authorised by you;
  • identity-verification service providers;
  • government agencies or databases where permitted or required by law; and
  • other service providers that assist Jarvis or the relevant lender with the finance application.

5. How we use your information

Jarvis may use information collected in connection with your finance requirements or a finance application to:

  • understand your finance requirements;
  • help you identify potentially suitable finance options from our panel of lenders;
  • conduct an authorised soft credit check through Equifax;
  • prepare and submit a finance application;
  • communicate with the lender about your application;
  • verify information provided as part of the application;
  • obtain or facilitate information required by a lender for its credit assessment where authorised and permitted by law;
  • communicate with you regarding the progress or outcome of the application;
  • prepare documentation required if finance is approved;
  • facilitate settlement of the financed vehicle;
  • comply with applicable laws, regulatory requirements and our obligations to our lending partners; and
  • manage enquiries, disputes, complaints, fraud prevention and record keeping.

Jarvis does not make the lender’s final credit decision.

6. Disclosure to lending partners

Where you ask Jarvis to assist you to obtain finance, we may disclose your personal and financial information to one or more lenders from our panel for the purpose of obtaining a finance quotation, assessing available finance options or submitting an application.

The relevant lender will handle information it receives in accordance with its own privacy policy, credit reporting policy, collection notices and applicable legal obligations.

Once information has been provided to a lender, that lender may collect additional information directly from you or from permitted third parties and may undertake its own credit assessment.

You should review the relevant lender’s privacy and credit reporting information when applying for finance.

7. Credit reporting and credit checks

Jarvis may directly exchange customer information with Equifax in connection with the finance process.

With your consent and where permitted by law, Jarvis may obtain a soft credit check from Equifax to assist in understanding your credit profile and identifying potentially suitable finance options.

A soft credit check does not constitute a formal application for credit, is not visible to credit providers as a credit enquiry and does not affect your credit score.

If you proceed with a finance application, the lender may conduct its own credit assessment and obtain credit reporting information from a credit reporting body. This may result in a formal credit enquiry being recorded on your credit report in accordance with applicable credit reporting laws.

Different lenders may use different credit reporting bodies. For example, Toyota Finance may obtain information from Experian, Equifax or illion. Customers should refer to the privacy and credit reporting information provided by the lender relevant to their application for details of the credit reporting bodies that lender uses.

Jarvis does not itself report customer loan defaults, repayment history or financial hardship information to credit reporting bodies and does not administer consumer credit accounts after settlement.

The relevant lender is responsible for its own dealings with credit reporting bodies and for complying with applicable obligations under Part IIIA of the Privacy Act 1988 (Cth) and the Privacy (Credit Reporting) Code.

8. Your rights in relation to credit reporting information

Where Jarvis has obtained credit reporting information from Equifax in connection with a soft credit check, you may contact Equifax directly regarding information it holds about you.

You may also contact the credit reporting body used by your lender to:

  • obtain a copy of your credit report;
  • request correction of information contained in your credit report;
  • opt out of permitted credit pre-screening for direct marketing purposes; or
  • request a temporary ban on the use or disclosure of your credit reporting information if you reasonably believe that you have been, or are likely to be, a victim of fraud.

Jarvis currently uses Equifax for its own soft credit-check process.

Other credit reporting bodies may be used by individual lenders. Customers should refer to the privacy and credit reporting policy of the lender relevant to their application for current details of those organisations.

9. Accuracy and correction of information

Jarvis takes reasonable steps to ensure that personal information we hold is accurate, up to date, complete, relevant and not misleading for the purposes for which it is used.

If you believe information held by Jarvis about you is incorrect, you may contact the Jarvis Privacy Officer and request correction.

Where the information in question forms part of a lender’s credit assessment, credit account or information held by a credit reporting body, the relevant lender or credit reporting body may be responsible for considering and making the correction.

Jarvis will, where appropriate, assist you to identify the relevant lender or credit reporting body and may forward or assist with a correction request where this is reasonably practicable and authorised by you.

Credit providers and credit reporting bodies have specific obligations under the Privacy Act and applicable credit reporting laws concerning correction of credit-related personal information.

10. Access to information

You may request access to personal information Jarvis holds about you by contacting our Privacy Officer.

Jarvis will respond to access requests in accordance with applicable privacy law. In some circumstances we may be permitted or required to refuse access to some information, in which case we will explain the reason where required by law.

If you wish to obtain a copy of your credit report or information held by a lender, you should contact the relevant credit reporting body or lender directly.

Where Jarvis has obtained a soft credit check through Equifax, you may also contact Equifax directly regarding the credit reporting information it holds about you.

11. Security and storage

Jarvis takes reasonable steps to protect personal and financial information we hold from misuse, interference, loss and unauthorised access, modification or disclosure.

Information may be stored electronically or in hard copy and is subject to security controls appropriate to its nature and sensitivity.

Access to finance information is restricted to employees, contractors and service providers who require access for legitimate business purposes.

Jarvis retains information for as long as reasonably necessary for the purpose for which it was collected and as required by applicable legal, regulatory and record-keeping obligations.

12. Overseas handling of information

Jarvis and the service providers we use may use information technology, cloud, data storage, software or other services that involve personal or financial information being stored, accessed, processed or transmitted outside Australia.

Where Jarvis is likely to disclose personal information to an overseas recipient, we will handle that disclosure in accordance with applicable privacy laws. Where practicable, information about the countries in which overseas recipients are likely to be located will be made available in our Privacy Policy or relevant collection notice.

When Jarvis submits information to a lending partner, that lender will handle the information it receives in accordance with its own privacy policy, credit reporting policy, collection notices and applicable legal obligations.

Lending partners and their technology and service providers may store, access, process or disclose personal information outside Australia. The overseas arrangements of individual lenders may differ and may change from time to time. Customers should refer to the privacy and credit reporting information provided by the lender relevant to their application for information about that lender’s overseas handling and disclosure practices.

13. Finance applications that are declined

The decision whether to approve or decline an application for finance is made by the relevant lender, not Jarvis.

If your application is declined, Jarvis may be able to assist you in communicating with the lender or considering whether another lender from our panel may be appropriate.

Where a lender has declined an application wholly or partly because of credit reporting information, you may have additional rights under the Privacy Act and credit reporting laws, including rights relating to obtaining your credit report.

14. Complaints

If you have a concern or complaint about the way Jarvis has handled your personal, financial or credit-related information in connection with the finance process, please contact our Privacy Officer.

We will investigate the complaint and respond within a reasonable period.

Where a complaint relates to a lender’s credit decision, administration of a credit contract, information reported by a lender to a credit reporting body or another matter for which the lender is responsible, we may refer you to the relevant lender.

Where a complaint concerns information contained in your credit report, you may also contact the relevant credit reporting body directly.

Depending on the nature of the complaint, you may also have the right to contact the Australian Financial Complaints Authority or the Office of the Australian Information Commissioner.

16. Changes to this Policy

Jarvis reviews its privacy and information-handling practices periodically and may update this Policy to reflect changes in legislation, our lending arrangements, technology or business practices.

The current version of this Policy will be published on the Jarvis website.
